Is Apple Sue Happy Over Podcasting?
Will Apple sue PodTech.net? (My employer) Scobleizer - Tech Geek Blogger Well I was going to entitle this post Apple Computer, the original podcasting assholes... but then I remembered that I kind of put my foot in my mouth when I called Tim O'Reilly the original Web 2.0 asshole when IT@Cork got served with a cease and desist.
Anyways, it would seem that Apple Computer has sent a cease and desist letter to Podcast Ready claiming that the terms "Podcast Ready" and myPodder" infringe. I don't know if this is true or not, but Wired is reporting it and if it is that's really too bad.
Like the term Web 2.0, I think that the term podcasting really belongs to all of us and that it's a little late to start deciding that you want to own it now.
Scoble wonders if he and PodNet are next. I hope not.

I tend to agree that podcast has already become a generic term and should not be the subject of a trademark. MyPodder may be a much closer question. Whereas it may relate to a podcasting service, the term itself, MyPodder, sounds pretty close to Ipod. Even if Apple is were not trying to protect "podcast" as a mark, they could arguably have a beef with MyPodder for a trademark claim or something along the same lines like dilution.
